1. Introduction

Save Your Billing ("we," "us," or "our") is committed to protecting the privacy and security of the Protected Health Information (PHI) we handle on behalf of our clients. This Privacy Policy describes how we collect, use, and disclose PHI in the course of providing medical billing services.

2. Scope

This Privacy Policy applies to the PHI we receive from healthcare providers, including hospitals, clinics, and physicians ("Covered Entities"), for the purpose of submitting claims, following up on payments, and other related billing activities. We operate as a "Business Associate" under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations.

3. Our Role as a Business Associate

As a Business Associate, we are required by law and our contractual agreements with our Covered Entity clients to:

Comply with HIPAA: We adhere to the HIPAA Privacy Rule and Security Rule, which govern the use and disclosure of PHI.

Protect PHI: We implement appropriate administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of PHI.

Use PHI only as permitted: We use and disclose PHI only as permitted or required by our Business Associate Agreements (BAAs) with our clients and as required by law.

Report breaches: We report any unauthorized use or disclosure of PHI (a "breach") to our Covered Entity clients as required by law.

4. The Information We Collect

The PHI we collect and process may include, but is not limited to:

Patient Demographics: Name, address, date of birth, phone number, and social security number.

Insurance Information: Health insurance provider, policy number, and group number.

Clinical Information: Diagnosis codes (ICD-10), procedure codes (CPT), and dates of service.

Financial Information: Account balances and payment history.

5. How We Use and Disclose PHI

We use and disclose PHI to perform our medical billing services on behalf of our Covered Entity clients, including:

Submitting claims to insurance companies: We transmit PHI electronically to payers (e.g., private insurance companies, Medicare, Medicaid) to seek reimbursement for services provided.

Following up on claims: We communicate with payers and patients to address claim denials, payment inquiries, and appeals.

Payment posting: We apply payments received from payers and patients to the correct patient accounts.

Generating reports: We provide our clients with reports on their billing performance.

Responding to patient inquiries: We may assist our clients in responding to patient inquiries regarding their bills.

Legal and regulatory purposes: We may be required to disclose PHI to law enforcement or other government agencies as required by law.

6. Data Security

We have implemented a comprehensive security program to protect the PHI we handle. Our security measures include:

Access Controls: Restricting access to PHI to only those employees who need it to perform their job duties.

Encryption: Encrypting data in transit and at rest to protect it from unauthorized access.

Auditing and Monitoring: Regularly auditing our systems and monitoring for security vulnerabilities.

Employee Training: Training our employees on HIPAA and data security best practices.

7. Your Rights

Patients have certain rights regarding their PHI, which they can exercise through their healthcare provider (the Covered Entity). These rights include:

Right to Access: The right to inspect and obtain a copy of their PHI.

Right to Amendment: The right to request an amendment to their PHI if they believe it is incorrect.

Right to an Accounting of Disclosures: The right to receive a list of certain disclosures of their PHI.

Right to Request Restrictions: The right to request restrictions on how their PHI is used or disclosed.

Right to a Confidential Communication: The right to request that their healthcare provider communicate with them about their PHI in a certain way or at a certain location.
